Can anyone tell me what is ADIT processing?
I am assuming that you got 485 approval letter and it talks about ADIT.
I think there was a long and detailed reply by somebody on this forum about ADIT

I 've had a similar situation recently - where my H1B (with employer A) was about to expire and then another employer (B) had to recruit me, they filed for transfer+extension.
In I129 while filing, they would have to select (cant recall the exact verbiage) new employer (related to transfer) AND extension of current status. Its better to file this kind of petition premium. I got the new approved petition within 2 weeks with new expiry date as +2yrs, with start date earlier than the H1B expiry date (with A).

The NC DMV is taking a really long time to validate my EAD. Its been over 60 days now since my license renewal based on EAD expiring October 2010. They keep sending me back with a temporary license valid for 15 days saying they are yet to validate and issue my perm license based on EAD.

The risk is that you do not know which petition will be approved first. According to the "last action rules" principle, the last petition to be approved will be your wife's status. For instance, if the H4 petition is approved last she may need to file a change of status to be in H1 or alternatively travel out and re-enter with the desired visa, and vice-versa.

neither lawyer nor employer received Labor Hard Copy until today. I missed I-140 Premium
Processing because of Hard copy.
I signed one page of the original document (which the employer/lawyer should send to you)

I want to travel to India on Advanced Parole and faced with a dilemma whether to take the risk based on my situation.
I have worked with Company A (Vision Systems) which was indicted in visa fraud last year. They have applied for H1 extension but the extension approval never came. As a result My H1 expired in july 2009 and I have worked till November 2009 with the H1 being pending. Afterwards I moved to another company and started working with them on EAD (applied GC for future employment) and Company A revoked my pending H1.
My concern is Will I be considered for unauthorized employment for the period of my work with Company A while my H1 was pending from July to Nov 2009.
I have heard that all these things will be checked at the port of entry while entering on AP. Also, since I worked with Company A which was indicted in visa fraud will it trigger any flags to the officers even though I am not with that company right now.
I would like to take your advice about this.

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

I did contemplate not filing for AP and keeping h1 and infact planned to get stamping; but after long thoughts i let it go. I figured not filing AP is not worth the risk.
IMO you should get AP and then travel, you sure can go for h1 stamping.

some retaliations (for wistleblowers) based on race, ethnicity etc. are illegal. however if it was just because they didn't agree with your behavior or business related thoughts then they are perfectly okay firing you.
saying that usually the onus is on the company to prove that it was not because of any of the protected category (race, ethnicity etc.)

Hi,
I will be done with my second master's this July 29. I have two months grace period to leave the country as I already used my OPT after my first master's. I have a job offer and they are willing to do my H1B which starts from October 2011. But my two months grace period will end this september 29. If my H1B is filed in September under Premium processing, will I be in status or out of status for those two days. Did any one face similar problem before. If so, can you please give me the solution?

On page towards the bottom it prompts the doctor to enter details of the tb skin test.
Did u actually take the test? If you did, then perhaps ur doc missed it.
If i remember correctly, the doc i went to gave us two copies of the form, one that was sealed for uscis and the other for our reference. Anyway, if they dont have a copy of it, get a new one and make sure this info is filled out and any attach any additional relevant doc and send it to uscis.
If u got a lawyer, i suggest you get them to send the info with an attached letter etc.
