Here is my estimate on the timeframe:
Prepare job description etc. - 1 to 2 months (depends on company and attorney)
Prevailing Wages - 2 months (this is based on the current centralized processing)
Recruitment Process - 2 to 3 months (depends on company and attorney)
PERM Labor approval - 9 months (if it gets audited, it would take around 2 years)
I140 - 4 months (you can reduce it if you can file premium processing)
I485 - This depends on the EB category & VISA dates - if it is EB3 India, it would probably be 7-10 years or more
I am not trying to be pessimistic. This is based on what I have observed and read. I have been in this country for 10 years on H1B. I am currently waiting for my Prevailing Wages request to be processes (for my 3rd labor application). It is a long process, but as long as you are working for a good company that treats you well, you should be able to endure the pain.

I entered US in 2001 on H1B and have not left the country since then. Unfortunately within few months of coming to US, I had a fight with my wife and was charged of domestic violence. This charge was later reduced and I was convicted of a simple battery.
Now if I travel overseas and come back on AP (I intend to use my approved AP instead of going for H1B stamping), can I be denied entry to US at port of entry because of my criminal charge?
Anyone in the same situation or know someone in this situation? Was there any issue in there re entry into US?

I need a little advice on sponspring my uncle vistor's visa from India
My uncle works in auto industry and I would like to nspor him for a vistor visa. His family will not be visting and he is taking care of his in-laws as well.
Does including his family members make any difference?
Also, having a different family name makes any difference in the sponsor's letter?
Any help is appreciated.

Travisa SF is a small setup ... there is one lady who manages the show (and she may have an asst or two). Your best option is to visit their office in downtown ... somewhere near Market St, I remember.
I had good experience with them for UK visa a few years ago ... good luck!

The safest route is to have both the H-1B and the EAD, if the employer agrees to pay for all. If you just have an EAD and the 485 is denied for some reason, you have no work authorization. If you have the H-1B also, then you can continue to work on that.
The filing fees for a H-1B extension depend on how many extensions have been filed already. Assuming it is not the very first H-1B, then the filing fee is $320, and $1500 if it is the first extension.

Hi All,
I lost my renewed EAD. It was approved for 2 years. My license is expiring in SEP 30th. Can I submit AP in DMV for status check. If I applying EAD for lost card, Can I at least submit receipt notice? I dont think I wont get replaced card before SEP 30. Please help me. I am not in H1B status.

It is always good to maintain L1A status. I think best way to apply your L1A extention under premium & family under normal. I think premium fee is only for primary application & not dependent. If anything goes wrong with I140, you will be ground zero on status. In that case, You may have to leave the country immediately.

I am working for a american company as a consultant thru a Desi Consultancy for past 6 years. And my H1 also held by the same desi consultancy company. My company filed for new H1 petion and got approved last october. He came to US on last friday (Newark, NJ)and was deported for some reason. I dont know the exact reason. So i have few question. I really appreciate all your help
1. My H1B is going to expir by Sep 2010 and i sent all the documents to file for H1 extn based on my approved I-140. My company lawer filed for LC and it is still pending. So is it going to affect my H1 extn?
2. How about my GC process? Does it affect if i apply I-485 when my periorty date become couurent?
3. What will happen to my company? My employer is stright forward guy. He has all the documention and Tax.

2. Employment letter from your current employer
3. If your current employer had filed/started GC process, then those document copies
You should be fine. When entering just answer the IO aptly. One common question is
1. Purpose of your visit?
2. Whom you are working for? <Be honest, tell them your current employer if asked>
If you are traveling on AP with family the above questions will be asked only to the primary person, they don't question others who are traveling with you.
