Hi,
I am currently in L1B visa , i am in US for 40 Months. The total period that i can be in US in L1B is 5 yrs .
I am planning to do my H1B this year (2008), having already elapsed 40 months, if i get a H1B will the period elapsed ( 40 months in L1B) be accounted or i will get the H1b for 3 yrs.

but we sent out the application package on June 28 (Friday) and the USCIS received our package on July 1st (Based on the Fedex tracking record). There is no way that my employer can refer to the new prevailing wage databse, which is released on July 1st.
Save the FedEx receipts etc, they might be useful in case of RFE.

I did not sign in the 325 form...where it says that sign here
"if your native alphabet is other than Roman letters, write your name in native alphabet below".
Would this be a concern?

did you forget to sign the G-325A form where it says "Sign here"

did you forget to write your name in native alphabet?
In first case, it will be considered improperly filed and chances are it will be rejected.
In second case, even if your native language is other than English, the person who does initial review will not know that and it will be accepted and processed.
I hope it is the second case .

My friend will come from India on H1B first time to Atlanta Air port this weekend. His H1B was approved for year 2008 and his stamping was done in early 2009. His H1B is from small desi consulting company. What kind of questions he may face? Any inputs will highly appreciated.
The IO at the border post may ask similar questions that he may have faced (or he may have prepared for) when he went for the visa interview at the consulate...

The first status is that USCIS has approved your EAD and ordered for a card. The second status means that they mailed you the card. You should get the card in next 5 business days.

Even though at will employment, you can ask for ticket. When they applied for your petition, they agreed for all laws governing H1B. No excuse for them. If they do not agree, contact the labor department.

EB-3 Skilled: Mexico(6,766), Korea(4,375), Philippines(4,114), Ecuador(3,747), Brazil(3,670), Poland(3,230), India(3,006), China(2,477), Pakistan(2,091)
Assuming there are atleast 300K Indians waiting for visa numbers in the EB2 + EB3 category (including dependents) and 6726 out of them were covered last year, we will have to wait for just another 44 years and 7 months to get an immigrant visa number. LOL
If everything goes well as planned atleast GC is assured for our children ( for some like me - grand children) .

There's no requirement for a person to be present in US while PERM or I-140 is getting processed.
During the AOS stage, a person may opt for Consular Processing or I-485. The former doesn’t require any presence in US whereas the latter does.

May be IV code is already aware and working on this. I think with the nuke deal out of the way, we now have a window of opportunity - may be Q1/Q2 2007 - during which we can try to get USINPAC, India caucus etc. to listen to us and hopefully actually do something.

I found this really old post 11 2004. I saw your tutorial for coloring code. I am need a coloring page for www.walrusdogblues.com My fantasy is to have five colors red blue and yellow black and white. and the ability to drop them in the drawings as needed to blend the colors. I just got off the phone with a second level rep at USCIS and am getting really confused with their mixed messaged. before i push any panic buttons can some one please let me know if they had any conversations with the idiotic bunch at uscis and share your conversations with regards to the visa availability for next month. this idiot states that vsc just oversubscribed and that it could be that there wont be any movement on the cases. all this over enthusiasm for nothing - that would really infuriate me. there is a limit to the fuss they can cause and play with emotions.
